recovering the ball at a ruck

hello,

I have a question as to the recovery of a ball in a ruck.
When may an opponent grabs the ball during a ruck please?
You always see the player with the ball with your back to the tryline roles and then detach the ball back to his teammate.
But can an opponent who grabs bared ball?

a player can only pick the ball up from a ruck once its clear or he has driven over it. Once a ref calls 'ruck formed' no one can pick it up, until that time if a player is onside and on his feet he can pick the ball up. The tackler only may do this immediately from any angle. This is a dark law very much refereed by self interpretation and inconsistencies!

However, in the interests of keeping the game flowing, we do allow the person acting as the half-back (usually, but not always, the No. 9) to pick up the ball in the back if the ruck if the ball is clearly won by his team and is available. The referee waits for a moment to see if the acting half-back picks up the ball. If he doesn't, the referee will call out "use it" and the acting half-back now has five seconds to pick up the ball. If he doesn't, the referee will blow his whistle and set a scrum, with the opposing team to throw in.
 
Your allowed to pick up the ball and hand it back to your team mates at any stage providing that the ref doesn't see you doing it :)

So in general, a tackler may get up on his feet and just take the ball from any side had there not been a ruck? If this is legal, is there any chance that a referee could get this wrong and give a penalty for the alleged infringement?
