It's getting penalised because you are out muscled in a scrum and unable to stop it legitimately much different to it you are out muscled in a maul and unable to stop it legitimately?
Having said that, I feel a penalty should only really be for if a team act cynically to prevent the team in possession from getting the ball back. If the ref deems a team header simply been out muscled then they should simply continue if the ball is available.
