The relegation run-in

i think that 5 point reduction is really going to bite LW up the arse sadly and i think there only chance left is to beat a worcester side full of beasts which is possible for them but they also have to hope sale dont find form and drop points
 
Appeal to be lodged, Welsh believe they have pretty good grounds to win the appeal. Lot more to this story than what is being said.

Even a partially succesful appeal could be very helpful, getting even a couple of points back could be a huge difference.

I think that LW have got off very lightly with 5pts and £15k as they were:

1) Guilty as charged;
2) Employing a player without a visa that allowed him to work in this country;
3) Not immediately alerting the RFU when concerns becoming apparent (forget the spin that they reported the issue - it would have come out as the RFU was not satisfied);
4) They bear some responsibility for their employee's actions who had authority to act on this issue;
5) They did not have appropriate systems in place; and
6) Even when an appropriate visa had been obtained TK was still played before he was properly registered.

Based on the fact that guy involved in the whole miss-management was sacked as soon as it was found out, the guy actually committed fraud. He led London Welsh to believe that he was registered above board. Regardless of where that source came from, London Welsh acted as soon as they knew. In regard to the visa, from what I have heard and know, Keats was apparently on a visa that allowed him to work (irrespective of what point 6 says) ... so I can't quite understand that point.

It is no wonder that the man involved is also facing his own punishment from the RFU.


EDIT: Having read the judgement document, I can see where the RFU are coming from, LW are the employers. However ... what's concerning is that Mike Scott fraudulent behavior and antics, and how the RFU could have stopped the rot sooner / acted sooner. For me, I hope Scott is punished ... very severely

Skimming the London Welsh fans forum, many are disappointed at the appeal and think they'll end up with a bigger penalty for doing so!

That's the risk ... it always will be. But I wouldn't think they would appeal if they thought they would:

1) Not have a case to appeal
2) Win the appeal

As I said before London Welsh are no mugs in the law department, they are blessed with some of the best guys in London to look after them.

Sadly for me and I know other London Welsh fans, the damage has already been done.
 
My end of season table puts Sale ahead of LW.
LW losing to Sale a few weeks back was the nail in the coffin.
 
Tough but fair I feel, Mike Scott does seem to have acted alone in this and thats why the punishment was not higher for Welsh but a club/company is responsible for its players/coaches/employees. The accusation regarding not reporting it as quick as they could have is (if true) understandable given what was at stake but still the wrong thing to do. They have fought hard to stay in the AP certainly more than Sale have and they still have a chance of staying up if they get the run of results they did this time last year to get promotion.
 
Is it just me, or should it just be that Welsh are penalised points in those games where Keats' involvement couldn't have gained Welsh any points? For example, Welsh shouldn't lose any points from the 15-34 loss to London Wasps, because they never gained any points to begin with (and so they didn't benefit from Keats' involvement)?

Seriously, Tyson Keate's wikipedia page very clearly states he's a Kiwi who used to play in Super 15, did they really think this wasn't going to get found out.

An appeal by the club might still work, they may not have known about the passport.

Kind of surprised they 'only' got five points to be honest, considering how serious this is.

The whole "guilty by association" thing. LW hired these guys so therefore ultimately they were responsible for the conduct whilst in employment. Based on that article I can't see any appeal being successful.

Exactly.
You run a business and an employee does something, you can be accountable.
 
Of course they are accountable ... but the man who as the centre of the entire thing is to blame. He's admitted the club didn't know. I tell you now, people writing off an appeal. Do so at your peril. Similar did the same for their promotion appeal. The same is possible here.
 
Yeah, Scott did seem to act independently.
I can't help but feel that while and appeal might be somewhat successful, LW will still take some blame.
 
Massive win for Sale over Bath, hard to see a way back for Welsh unless the appeal goes in their favour.
