Which is the representatives fault for including them in the action

Well when 10 people turn into hundreds, and some high profile names, can you fault the reps for adding them? Theyve certainly created a huge profile case, and well it wouldnt have surprised me if GBs had just settled to get the bad publicity away from the sport...

In the WRUs case though, they love killing the sport, anything to drop junior particiaptation and muddy the sports name and theyre in, the only thing the WRU havnt been accused of so far is um... you know what. Im sure its just round the corner

Yes, I can fault the rep.s for adding them.
This is a court case, evidence is required. If you don't have the evidence, don't include them.

It's really, really simple.

Either you have evidence, in which case you MUST produce it, or you don't, in which case, you have no case.

If you add the 100s in the hopes of an out-of-court settlement and no production of evidence, the it's your own fault if you bluff is called and it becomes a court case where the evidence is required.

It is 100% Ryalnds fault that Rylands haven't been doing their job.

Your right, if you ignore public senitment, or pressure in any high profile case.

Or if you ignore that less than 5% of suits go to decision with sports GBs.

Lawyers fails at lawyering, repeatedly and clearly. Is actively in contempt of court for their failure to lawyer.
Lawyers don't have any of the evidence needed to build a legal case, but insists that the legal case be built.

But it's no fault of the lawyer.

Presumably it's the fault of those pesky defendants and judges who expect a lawyer to have basic competence, or to do oly with court orders.
Must be their fault, no-one could possibly attach any blame to person who's actually failed at their job.

I mean, if you want to ignore the facts above, then blame the lawyers 100%, but there are a number of reasons these cases may break down, just blaming the lawyers is a bit silly is it not?

We dont know the ins and outs of the case, the complainants claims, and conversations, the jostling behind the scenes etc...

Put together by someone else, elsewhere with more time on their hands than me.

So, the lawyer Richard Boardman, and his firm that he is the sole director of, Rylands Garth, who are representing the players in this case, have (allegedly) in rough chronological order:

Used shady business practices and predatory billing to try and get Will Green to sign up despite an independent second medical opinion showing no evidence of neurological issues [https://www.fionabruce.co.uk/sra-investigation-into-rugbys-concussion-claim/] which does raise the question of how many other players involved have either been misdiagnosed or financially pressured to remain involved despite doubts.

Failed to submit medical records for half of the rugby league claimants and 1/5 of the union claimants, got berated by the judge for "failing to grasp the English language" and showing "a complete misunderstanding of his responsibilities", appealed that ruling and then got berated by the appeal judge for "gross misunderstandings about his disclosure duties”, “puzzling nature of these fundamental misconceptions,” and “unconvincing explanations.” [https://archive.ph/nYQbP]

Submitted a statement of truth (a legal confirmation that a document is correct and truthful) for a statement by Dominic Ryan, after having altered said statement themselves and without Ryan's confirmation that he was happy with the altered statement [https://archive.ph/brSZi]. Dominic Ryan subsequently dropped out of the action against the RFU, but is proceeding against Aviva in a separate court case and I will present you with this snippet of reporting on the doctor that Rylands Garth have been using to assess players:

Dr Allder, a consultant neurologist who performed an assessment of Ryan on March 25, 2021, is accused of then producing two different reports: one for Ryan in his litigation with Aviva on July 5, 2021 and then for Rylands Garth dated on Nov 7, 2023.

The report states: “Dr Allder offers materially different conclusions on the causation in each of his reports despite the reports arriving from the same examination.”

Notified the court that he was stepping down from the case and will no longer represent the players. [https://archive.ph/z0zGg] That might have been a good thing, except that most of the players didn't know about this before it occurred and their side is now bereft of legal representation, with other firms understandably a bit wary of stepping in considering the colossal hash made of things so far and the fact that the judge is currently retired to consider whether to strike 530 claimants from the lawsuit.

Of course, no blame can be attached to the Lionel Hutz, attorney at law for being told by 2 different judges that he doesn't know what he's doing.
He really is doing his best to make ambulance chasing lawyers look even worse than they actually are.
